Probate is a formal process for distributing a person’s assets after they die. The court fulfills estate administration responsibilities that are typically performed by the Personal Representative. These duties may involve.

Probate Isn’t Mandatory

An estate’s representative must file a decedent’s will and other formal documents, but Washington laws don’t require a formal probate process. The court doesn’t take an active administration role unless the estate falls within certain parameters.

  • The decedent owned over $100,000 in personal property
  • The decedent held title to real property in their name
  • A potential beneficiary contests the will
  • An issue arises involving jointly owned property without right of survivorship
  • Someone contests the personal representative’s authority or decisions
  • The court must review a request to appoint a different personal representative

If the decedent owned property in another state, the personal representative must also comply with that state’s probate rules.
